Contract conclusion

1.Our offers’ technical specifications and prices are subject to change at any time for a valid reason, provided we notify you at least 30 days prior to your next due date.

2.Upon placing an order, the customer is obligated to accept the tentative offer.
We will immediately confirm receipt of the customer’s order.
The confirmation is non-binding contractually.
The contract’s confirmation and acceptance may be combined.

3.We are entitled to accept a contract offer (the order) within five working days of receipt.
Additionally, we have the right to reject an order based on our assessment of the customer’s reliability.

Integrity of data

1.The customer is responsible for regularly backing up their data.
When this service is included in the offer, we will backup the server on a regular basis.
In the event of data loss, the customer is responsible for re-transferring the relevant databases to us free of charge.

2.The customer is required to perform a complete data backup prior to making any changes.

3.For security purposes, the customer will be provided with a user ID and password.
This information must be kept private.
The client will be held liable for any malpractice that occurs as a result of the password being used in an unauthorised manner.
If the customer becomes aware that unauthorised third parties are in possession of the password, they must immediately notify us.
If the customer is responsible for third-party password abuse, the customer is responsible for all associated user fees and damages.
In suspicious circumstances, clients can request a new password, which we then send to them.

Privacy

1.Personal data about customers will be collected and used only to the extent necessary for the establishment, maintenance, or modification of the contractual relationship.
The client is responsible for maintaining these data through its online administration interface.

2.The client’s email address will be used solely for order confirmation, invoices, and – if the client consents – customer care, as well as for our newsletter, if the client so desires.

3.With the exception of our service partners who are required to determine remuneration and settlement with the customer, we do not disclose any personal client information to third parties.

4.The client has a right to information and the ability to amend, suspend, or delete the information that has been saved.
If deletion conflicts with a legal or contractual obligation to preserve data or with other legal grounds, the data will be rendered inaccessible.

Published Content

1.The client agrees not to publish content that infringes on the rights of third parties or violates the law in any way.
It is prohibited to post erotic, pornographic, extremist, or otherwise objectionable material.
We reserve the right to disable access to any customer who violates this.

The same is true if the customer publishes content that may constitute a violation of the rights of individuals or groups of people, or that insults or denigrates these individuals or groups.
This is true even in the absence of a legitimate legal claim.
We are not obligated to review the content submitted by our customers.

2. Spam email is prohibited.
This includes, but is not limited to, the transmission of unlawful, unsolicited advertising to third parties.
It is prohibited to provide false sender information or to conceal the sender’s identity in any other way when sending Emails.
We reserve the right to terminate access if these terms are violated.

3.It is strictly prohibited to host phishing pages or malware.

4. Stress testing/exploitation of other websites or clients is prohibited, even if the other website provides an authorization letter authorising you to conduct pen-testing on our infrastructure.
